Method Pharmaceuticals inappropriately claimed that its generic product (Me-PB-Hyos) was a legal generic alternative and substitutable for Concordia Pharmaceuticals’ product – Donnatol. The Court believed that the claim was willful and constituted false advertising under the Lanham Act and deserved not only $733,200 in compensatory damages but trebled its damages to $2.2 Million.
